IM “Orange Moldova” S.A., with registered office established at 75, Alba Iulia Str., Chişinău, MD-2071(hereafter referred to as "Orange") makes available mobile software applications (hereafter referred to as "the Service"). The present general conditions of use (hereafter referred to as the "General Conditions") define the conditions for use of the Service by the customer (hereafter referred to as "you" or "the User"). Everyone who accesses the Service undertakes to comply with the present General Conditions without any reservation.
The Service is described on the (mobile) page from which the mobile application can be downloaded. In order to be able to use the Service, you must at a minimum possess a properly configured mobile device (either a smartphone or a tablet) and an Orange SIM card with access to the internet. Moreover, the device must be compatible with the Service. The Service is exclusively intended for normal private and personal use. Through the Service, you as an Orange client, can manage your Orange account, including: access data on the balance and tariff plan information, manage (activate or deactivate) options and bundles, recharge Orange accounts and discover features and services, while being online. Authentication in the Service is automatized and does not require any action on your side. If you want to be definitively disconnected from the Service, it is required to manually uninstall the mobile app from the device. 1.1 The “Anti-spam Protection” feature allows the User to be informed about the potential nature of an incoming call from a phone number that is not stored in the User’s phone book. This information is based on the automatic classification of the number using algorithms or data shared from the Service users’ reports. The automatic blocking function for calls identified as spam or telemarketing is also available. By activating it, the User will receive fewer unwanted calls, as these will be blocked directly on the User’s phone.
The Service can contain HTML links to websites that are set up and/or managed by third parties (hereafter referred to as "the Sites of Third Parties") over which Orange exercises absolutely no form of control. In so far as absolutely no control is exercised over these external sources, the User acknowledges that Orange bears absolutely no responsibility with regard to the availability and/or the content of the Sites of Third Parties or of the sites to which the Sites of Third Parties might refer. You acknowledge that all of the information (such as data files, texts, software, music files, audio fragments, photos, videos or other images) to which you can receive access within the framework of or by means of your use of the Service (hereafter referred to as "the Content") falls exclusively under the responsibility of the person who is at the basis of this Content. You acknowledge that, through your use of the Service, you may be exposed to Content that you find hurtful, obscene or unacceptable. In this respect you acknowledge that you use the Service entirely at your own risk. Parents and all other persons who exercise parental authority are reminded that it is their task to, firstly, determine which service(s) their minor child may or may not use and, secondly, to supervise the use of this service or these services by their child(ren).
Use of Service in Orange mobile networks does not usually incur data connection costs, except certain cases, of which User is informed through a notice in the application. In certain cases, during the downloading or use of the Service, Orange reserves the right to charge the User data connection costs at the applicable rates of his contract. Your use of the Service can mean that you, by means of the Service or through your use of the Service, surf to a (mobile) website, use a service, download software or purchase a product, that is delivered by another person or another company. This can entail communication costs and other extra costs that are not included in your contract. Accessing the Service while roaming in mobile networks abroad generates Internet traffic charged as per the roaming tariffs in force (For details please consult Orange Price list on www.orange.md).
The Service is delivered "as is". Orange and its partners offer absolutely no guarantee in this respect (including any implicit guarantee with regard to satisfactory quality, compatibility with a specific use or conformity with the given description). In particular, neither Orange nor its partners guarantee that: your use of the Service will meet your requirements; your use of the Service will take place in an uninterrupted, fast, secure or error-free manner; all of the information that you receive as a result of your use of the Service will be correct or reliable; and defects in the operation or the functions of any software that is delivered within the framework of the Service will be repaired. You acknowledge and accept that the form and the nature of the Service, such as this is provided by Orange, can be modified occasionally and without advance notice. You acknowledge and accept that Orange, without advance notice and entirely at its own discretion, can decide to deny you delivery of the Service or the functions thereof completely or partially, definitively or temporarily. Orange and its partners cannot be held responsible by the User: for any indirect or collateral damage that you might suffer and for whatever (directly or indirectly incurred) loss of income, business, clientele, reputation or data that you might suffer; for whatever loss or damage you might suffer as a result: of any changes that Orange may make to the Service or of the permanent or temporary discontinuation of the delivery of the Service (or of any characteristics of the Service); of the non-functioning or poor functioning of the Service due to the actions of a virus that was transmitted via the internet or mobile phone network and that affects both the functions of the telephone and the Orange network; of an abnormal or prohibited use of the Service by the User; of the incompatibility or the non-functioning or poor functioning of the devices, in particular the terminals, that are used by the User with this Service; of the non-functioning or poor functioning of the Service due to the settings of the mobile phone and/or the changes to the operating software that was delivered together with the mobile device being used. These settings and/or changes fall entirely within the User’s scope of responsibility. By accessing the Orange account/ using the Service you are responsible for all actions and consequences arising from such use of Service. Orange is not responsible for any errors or consequences arising from the User’s negligence in protecting the security and confidentiality of his/her Orange account or device. The User understands and agrees that the information displayed by the Service with regard to his balance, tariff plan and services provided are delivered by the system for information purposes only. All options/bundles activated through the Service (such as acquisition of new options/bundles or their extension) are binding for User, who shall pay for their cost, as per then current tariffs.
MyOrange application does not collect additional data from the User. Certain personal data from Orange's IT systems are necessary for the proper functioning of the application. The Service / application must be able to indicate, for example, the Orange account balance and the tariff plan information, what the user has consumed or which services/products have been activated. The User's personal data are necessary to carry out these tasks. The data processing during use of the Service / application occurs in accordance with Orange Moldova Policy on Data Privacy for Clients (users) available at www.orange.md. My Orange application collects information on the use of the application and sends to us such information for statistical analysis to further improve the service provided to you. The collection of such data also allows us to improve the relevance of the notification messages sent by the service. All collected use information is completely anonymous and is not associated with the User. Such information is collected and processed in compliance with applicable laws. It will not be used for any other purposes than improving the service and the relevance of the notification messages. Any personal data are NOT collected. You can disable, at any time, collecting information. For this purpose, you have an option in the application settings available in the settings of your terminal equipment. My Orange application collects and processes the categories of personal data stated in the description of Service, such as: the mobile number and offers you the localization function (through GPS), for purpose of authentication and ensuring proper performance of Service and for other objectives stated in the description of Service. Except for personal data expressly stated in the description of the Service, Orange does not process the personal data of its customers during the downloading, installation or use of the Service. If your personal data are processed, Orange assures you that the processing takes place in accordance with the Law No. 133 of 8 July 2011 on the Protection of Personal Data. Your personal data are used exclusively with a view to the proper performance of the Service or with a view to objectives that are expressly set forth in the description of the Service. You have the right to inspect, object and modify your personal data at any time, through a written request addressed to the party responsible for the processing: I.M. “Orange Moldova” S.A., 75, Alba Iulia Str., Chişinău, MD-2071. The subscriber who shares their internet connection with third parties, either by providing the password to the access point (hotspot) created by him or by offering the possibility of using this connection without entering the password, bears the risk of unauthorized access to their data in the "MyOrange" account by those respective third parties.
You acknowledge and accept that Orange (or its partners) is the lawful holder of all rights on the Service, including all intellectual property rights relating to the Service. Orange grants you entirely free of charge a limited, personal, non-transferable, non-exclusive and worldwide licence for the use of the software that is delivered to you by Orange within the framework of the Service such as it is provided by Orange. This licence is exclusively intended to make use of the Service that is provided by Orange, and this fully in accordance with the present General Conditions.
The present General Conditions are governed by Moldovan law. Any dispute regarding the existence, interpretation or execution of these General Conditions falls within the exclusive jurisdiction of the competent courts of the Republic of Moldova.
Orange can modify these General Conditions at any time. In this case, Orange will make the modified General Conditions available on www.orange.md. You acknowledge and accept that, if you use the Service after the date on which the General Conditions were modified, this use signifies that you have accepted the modified General Conditions.
